Abstract

The praise of ALLAH, Lord of all worlds and prayers and peace be
upon His most honorable messenger. This research entitled: Legal Agency:
Jurisprudence and Application: Agency is one of the indispensable life
matters in societies and sometimes it is urgent and very important for humans
and also in the rights of religion such as zakat and others. I touched on the
introduction, conclusion and conclusions and divided the research into two
sections and the sections into demands. The first section covered the
definition of the agency, its legitimacy, its provisions, and the conditions for
the validity of the agency. The second section covered what the agency is
concluded with, the agent's behavior, the description of the agency contract,
and the dismissal of the agent. It concluded as follows: Whoever is permitted
to dispose of what he is entrusted with; his agency is permissible and his
agency is permissible. Except for the discerning child, his agency is valid in
terms of permission to enter the house and carry a gift. It is permissible to
delegate the rights of human beings, such as contracts, annulments, divorce,
emancipation, establishing rights, fulfilling them, and releasing them from
him. The agency is not concluded except in a known and permissible
disposition. Any disposition that a person may undertake personally is
permissible for him to delegate in it, and the agency is valid. Every statement
indicates permission. The principal is required to be the owner of the act for
which he is delegated, i.e. competent to carry out it. The power of attorney is
valid from one who is interdicted due to foolishness or negligence. The agent
is also required to be of sound mind and discernment. The power of attorney
entails proving the guardianship of the act covered by the power of attorney.
