38. قواعد تحديد المسؤولية الجنائية للمريض النفسي والعصبي
Abstract
The study dealt with the rules for determining the criminal responsibility of the mental and neurological patient, with the aim of defining the judicial rules for determining criminal responsibility, and identifying what mental or neurological disease does not affect criminal responsibility. Based on the objectives of the study and the problem that it addresses, it followed the comparative descriptive analytical and inductive approach. One of the results of the study is that the suspension of investigation or trial procedures does not include all procedures. It is in the rule of these procedures, the study recommended stricter punishment in crimes whose perpetrator claims to have a mental or nervous disease, then the psychiatrist confirms that this is not true, and the need to set clear criteria for mental and neurological disease that drops criminal responsibility.
